We, the jury, wish to make the following recommendations:


Inquest into the death of:

Marc Lafreniere


Jury Recommendations

To the Ministry of Labour:

  1. That the Ministry of Labour consider providing proactive education for small surface mining businesses on the governing regulations, guidelines, codes, standards and supports available.
  2. Amend regulation 68 of the Ontario Health and Safety Act to include surface mines.

To the Industry Health and Safety Associations:

  1. Have the surface mine industry consider, as guidelines, the use of road markers, flotation Argo units for transportation and inspection of roadways, a minimum of two people at all times on the worksite, communications available, and that employees should wear flotation devices when conducting black loam mining.
  2. Training on the operation of heavy equipment should include a review of all emergency exit procedures.
