We, the jury, wish to make the following recommendations:
Inquest into the death of:
To the Ministry of Labour:
- That the Ministry of Labour consider providing proactive education for small surface mining businesses on the governing regulations, guidelines, codes, standards and supports available.
- Amend regulation 68 of the Ontario Health and Safety Act to include surface mines.
To the Industry Health and Safety Associations:
- Have the surface mine industry consider, as guidelines, the use of road markers, flotation Argo units for transportation and inspection of roadways, a minimum of two people at all times on the worksite, communications available, and that employees should wear flotation devices when conducting black loam mining.
- Training on the operation of heavy equipment should include a review of all emergency exit procedures.
