Subsection 74.(1) Protection from Personal Liability
"No action or other proceeding for damages shall be instituted against a firefighter, a fire co-ordinator, a community fire safety officer, a member or employee of the Fire Safety Commission, an assistant to the Fire Marshal, the Deputy Fire Marshal, the Fire Marshal, or a person acting under his or her authority, for any act done in good faith in the execution or intended execution of his or her power or duty or for any alleged neglect or default in the execution in good faith of his or her power or duty."
This Subsection was incorporated from the Fire Fighter's Protection Act. The wording has been changed to coincide with the definitions in the revised Act. This subsection provides for immunity against the named persons where they execute their powers in good faith.
Is immunity from liability also provided to members of community fire safety teams?
Community fire safety officers are listed specifically because they may be employed individually by a municipality or as part of the community fire safety team. Provided they are immune from liability as a community fire safety officer, by extension they are also immune as a community fire safety team member.
