We, the jury, wish to make the following recommendations:
Inquest into the death of:
Robert Garry Cyr
To the Ministry of Labour:
- Expand the definition of an employee to include any individual(s) or worker(s) performing any duties or value added tasks on all commercial construction sites in Ontario.
- On a commercial construction site, a worker should be presumed to be an employee. The onus to dispute this presumption should be the responsibility of the employer, not the Ministry of Labour.
- There should be public service education targeting transient workers to help individuals understand their rights, responsibilities and obligations for their own safety. Promote zero tolerance drug policy and reinforce best practices for working at heights on commercial worksites.
